Después de discutir diversas hipótesis acerca de la especificidad de la poesía, se reivindican sus posibilidades relativas a la expresión de lo paradójico. Ello se ejemplifica en cuatro poemas del libro La línea del tiempo de Luis Fernando Macías. Y a partir de la estructura paradójica del tiempo se realizan algunas consideraciones relativas a la condición paradójica de la existencia y a los orígenes del conflicto trágico.

Robert Alexy has argued that the democratic objection to judicial review of legislation can be successfully addressed by assuming that judges exercise a special form of argumentative representation. In this article we argue that Alexy does not explain (as he should) under what circumstances judicial review tends to produce better decisions than parliamentary procedure, nor does he explain how judicial review can have a greater intrinsic value than parliamentary procedure. Subsequently, we argue that the intrinsic value of argumentative representation depends (...) on the promotion of citizen deliberation, whereas its instrumental value depends on judges being committed to the rights of discrete and insular minorities in the face of hostile majorities. El objetivo de este artículo es problematizar las críticas que hacen Fodor y Lepore en Holism: a shopper’s guide a la teoría holista propuesta por Donald Davidson. Para hacerlo, primero se hará una exposición de la teoría davidsoniana y se expondrán tres de las críticas hechas por Fodor y Lepore: la composicionalidad es necesaria para evitar los enunciados-W; la condición epistemológica de un intérprete radical es problemática; el principio de caridad no tiene ningún uso en la teoría del significado, entonces (...) no se puede derivar una conclusión holista de este principio. Una vez claras las críticas de Fodor y Lepore, se argumentará por qué no tienen un fundamento fuerte y se señalarán alguno problemas que quedan por resolver. (shrink)

The concept of vital force – the immanent energy that promotes the processes of life in the body and in nature – has proved a source of endless fascination and controversy. Indeed, the question of what vitalizes the body has haunted humanity since antiquity, and became even more pressing during the Scientific Revolution and beyond. Examining the complexities and theories about vital force in Spanish modernity, Nicolás Fernández-Medina's Life Embodied offers a novel and provocative assessment of the question of bodily (...) life in Spain. Starting with Juan de Cabriada's landmark Carta filosófica, médico-chymica of 1687 and ending with Ramón Gómez de la Serna's avant-gardism of the 1910s, Fernández-Medina incorporates discussions of anatomy, philosophy, science, critical theory, history of medicine, and literary studies to argue that concepts of vital force served as powerful vehicles to interrogate the possibilities and limits of corporeality. Paying close attention to how the body's capabilities were conceived and strategically woven into critiques of modernity, Fernández-Medina engages the work of Miguel Boix y Moliner, Martín Martínez, Diego de Torres Villarroel, Sebastián Guerrero Herreros, Ignacio María Ruiz de Luzuriaga, Gaspar Melchor de Jovellanos, Pedro Mata y Fontanet, Ángela Grassi, Julián Sanz del Río, Miguel de Unamuno, and Pío Baroja, among others. Advocates of paid living kidney donation frequently argue that kidney sellers would benefit from paid donation under a properly regulated kidney market. The poor outcomes experienced by participants in existing markets are often entirely attributed to harmful black-market practices. This article reviews the medical and anthropological literature on the physical, psychological, social, and financial harms experienced by vendors under Iran's regulated system of donor compensation and black markets throughout the world and argues that this body of research not only documents (...) significant harms to vendors, but also provides reasons to believe that such harms would persist under a regulated system. This does not settle the question of whether or not a regulated market should be introduced, but it does strengthen the case against markets in kidneys while suggesting that those advocating such a system cannot appeal to the purported benefits to vendors to support their case. Within the debate concerning reason and rationality, instrumental incoherence was for a long time conceived of as the paradigm of irrationality. However, with the emergence of the so-called ‘bootstrapping objection’ and the debate concerning the ‘scope’ of rational requirements, the innocuous status of the normative significance of (instrumental) coherence became subject to. This led to a paradigmatic shift in how to understand the relationship between rational requirements and normativity. While there now exists considerable doubt that rational requirements are normative, it (...) is commonly agreed that one’s normative point of view is a key feature of one’s rationality. Here the question is not only if one can hold a particular normative judgement and still be rational; what is significant too is whether your normative outlook coheres appropriately with your motivation. In fact, it is now commonly agreed that rationality requires us to intend to make the world fit with our first-personal ought beliefs. Enkrasia (i.e. coherence between your normative views and your motivation) is thus seen as a rational ideal and as a source of rational requirements. Nevertheless, many elementary questions regarding the application, content, and significance of an enkrasia-requirement remain unanswered, or subject to debate. This special issue on ‘The Nature of the Enkratic Requirement of Rationality’ aims to answer some of these fundamental questions. (shrink)

Economic environmental valuation remains a much debated and contested issue. Concerns have been voiced that it is unable to capture the manifold immaterial values of ecosystems due to conceptual and methodological issues. Thus, additional value categories (social values) as well as novel valuation approaches like deliberative (monetary) valuation are areas of growing interest, yet the theoretical foundations are rather weak. Against this background, this article aims to develop a consistent conceptual framework for making sense of social values in economic environmental (...) valuation. Based on a holistic view of society and individuals, the role of institutions, the social environment, culture and transcendental values is emphasised. To synthesise diverging concepts of value into an economic concept and to account for the multidimensionality of social values, the framework consists of three spheres: social, natural and contextual. The novel framework demonstrates that social values may be integrated into a preference-based utility framework when denoting a holistic understanding of social preferences and human embeddedness in nature and society. Reasoning that compares two objects or situations to draw conclusions about previously unknown properties of one of them has traditionally been taken to be ampliative and probabilistic. I propose that it is apodeictic reasoning from a premise about isomorphic structures that is often uncertain, but which we may have good reasons to believe. I characterize the structures and their isomorphism, describe patterns of reasoning appropriate to them, and discuss some complications not immediately obvious.

One common objection to establishing regulated live donor organ markets is that such markets would be exploitative. Perhaps surprisingly, exploitation arguments against organ markets have been widely rejected in the philosophical literature on the subject. It is often argued that concerns about exploitation should be addressed by increasing the price paid to organ sellers, not by banning the trade outright. I argue that this analysis rests on a particular conception of exploitation, and outline two additional ways that the charge of (...) exploitation can be understood. I argue that while increasing payments to organ sellers may mitigate or eliminate fair benefits exploitation, such measures will not necessarily address fair process exploitation or complicity in injustice. I further argue that each of these three forms of wrongdoing is relevant to the ethics of paid living organ donation, as well as the design of public policy more generally. (shrink)

The genus problem of populism presents one of the most vexing conceptual questions across the social sciences: Some theorists believe that populism is nothing more than an assembly of discursive patterns, while others maintain that populism is a strategy to gain political power. Then there are those that argue that populism is a thin ideology that lacks a coherent set of guiding principles. The paper intervenes in this debate in two ways: First, it offers a methodological apparatus for evaluating and (...) developing contested concepts such as populism. Second, it puts forward and defends the claim that populism can be fruitfully understood as a coherent ideology that rests on four foundational principles. These principles, I will argue, are necessary for explaining the paradigmatic beliefs and dispositions exhibited by exponents of populism. One of the key characteristics of populism, on the account developed in this paper, is its peculiar epistemic stance. (shrink)

In recent years, tech evangelists have made headlines predicting that in the future manual driving will be outlawed. This essay will investigate the question whether a ban of human driven cars can be defended on moral grounds in a future scenario in which autonomous cars are going to be significantly safer than manually driven cars. This article will argue that in such a future scenario manually driven cars, for moral reasons, indeed should be banned from participating in regular traffic. Since (...) the moral argument for outlawing manually driven cars will likely be met by resistance by car-aficionados, in the final part of the paper, we are devising a proposal for reconciling the strong moral case for a ban of manually driven cars with the widespread fondness of manual driving. This paper aims (a) to provide characterizations of realism and instrumentalism that are philosophically interesting and applicable to economics; and (b) to defend instrumentalism against realism as a methodological stance in economics. Starting point is the observation that ‘all models are false’, which, or so I argue, is difficult to square with the realist's aim of truth, even if the latter is understood as ‘partial’ or ‘approximate’. The three cheers in favour of instrumentalism are: (1) Once we have usefulness, truth (...) is redundant. (2) There is something disturbing about causal structure. (3) It's better to do what one can than to chase rainbows. (shrink)

The importance of fairness in machine learning models is widely acknowledged, and ongoing academic debate revolves around how to determine the appropriate fairness definition, and how to tackle the trade-off between fairness and model performance. In this paper we argue that besides these concerns, there can be ethical implications behind seemingly purely technical choices in fairness interventions in a typical model development pipeline. As an example we show that the technical choice between in-processing and post-processing is not necessarily value-free and (...) may have serious implications in terms of who will be affected by the specific fairness intervention. The paper reveals how assessing the technical choices in terms of their ethical consequences can contribute to the design of fair models and to the related societal discussions. (shrink)

This essay criticizes the current approach to epistemic democracy. Epistemic democrats are preoccupied with the question of how a society can best exploit a given stock of knowledge. This article argues that the problem-solving capability of a society depends on two factors rather than one. The quality of decision-making depends both on how a democracy is able to make use of its stock of knowledge and on the size of the knowledge stock. Society’s problem-solving capability over time is therefore a (...) function of its ability to develop its knowledge exploitation mechanisms and the growth rate of its knowledge stock. Based on this enhanced model of social problem-solving, this essay compares two different political ideal types: experimental democracy, as commonly defended by epistemic democrats; and polycentric democracy, a model defended most commonly by political economists. Like any social science, management and organization sits astride two literary and epistemic disciplines; the empirical and the conceptual. I argue that emphasizing the former to the detriment of the latter, as is often the case in management and organization research, creates a conceptual blindness that compromises progress in the field. I show how adopting a more philosophically attuned methodology buttresses the conceptual tools of management and organization research via deduction, induction, normative grounding, and overcoming the illusion of unanimity.

Opposition to utopianism on ontological and political grounds has seemingly relegated it to a potentially dangerous form of antiquated idealism. This conclusion is based on a restrictive view of utopia as excessively ordered panoptic discursive constructions. This overlooks the fact that, from its inception, movement has been central to the utopian tradition. The power of utopianism indeed resides in its ability to instantiate the tension between movement and place that has marked social transformations in the modern era. This tension continues (...) in contemporary discussions of movement-based social processes, particularly international migration and related identity formations, such as open borders transnationalism and cosmopolitanism. Understood as such, utopia remains an ongoing and powerful, albeit problematic instrument of social and political imagination. (shrink)

What, if anything, is the import of Hayek to epistemic democracy? Although Hayek is revered by epistemic democrats for his insights into the epistemic aspects of the market sphere, it is generally believed that his theory is moot with respect to democratic reason. This paper aims to challenge this verdict. I argue that a Hayekian analysis of inclusive public deliberation contributes at least three valuable lessons: (1) Hayek makes the case that under certain conditions even unbiased deliberators are permanently unable (...) to converge on the best available policy option. Call this the problem of ‘persistent hidden policy champions’. (2) He demonstrates that to unlock hidden policy champions, reasonable minority factions need the opportunity to act on their own evidential standards. (3) He challenges epistemic democrats to think more carefully about how to design the “epistemic basic structure” (Kurtulmus and Irzik 2017) of society in order to account for persistent hidden policy champions. Drawing on a wide range of Kant's recorded thought beyond his Groundwork for the Metaphysics of Morals, this essay presents an overview of Kant's account of practical agency as embodied practical agency and argues against the intellectualized interpretations of Kant's account of practical agency presented by Christine Korsgaard and Henry Sidgwick. In both Kant's empirical-psychological and metaphysical descriptions of practical agency, he presents a recognizably human practical agent that is broader and deeper than the faculty of reason alone. This agent (...) chooses action from a reflective distance, but not from the complete affective distance of reason. We choose neither as reason alone, nor even as the sum of all of our ‘higher’ faculties, of cognition (including reason), feeling, and desire, in Kant's view. Instead, we choose as an agent that also has ‘lower’, ‘sensible’ faculties, of cognition (including sense), feeling, and desire, which together comprise our ‘sensibility’. These mental states of sensibility are not merely confused versions of our higher cognitions, feelings, or desires, and so different from them in degree only, but are instead distinct from our higher states in kind also; and these distinct sensible states are not dependent on our higher states and so on a commitment to the value of humanity, for example. For this reason, a choice in favour of sensible states and in opposition to the moral law need in no way undermine its own foundations and thus be incoherent, as Korsgaard and Sidgwick argue, but instead only immoral. Because Kant does not reduce the problem of immoral choice to one of insufficient reflection and ensuing confusion, he does not view moral progress in cognitive terms alone, whether in the form of a clearer understanding of the moral law, improved judgment in applying it, or deeper insight into our own nature as practical agents. Kant instead recognizes the crucial importance of cultivating our feelings and desires over the course of a lifetime both as a way to make ourselves worthy of the humanity within us directly and also as a way to facilitate future moral choices. At the University of Pretoria the author, a practical theologian, experiences a fruitful soil for the development of an interdisciplinary process. He referred to concrete examples of cooperation, but used the article to reflect on best practices for the interdisciplinary dialogue. He came to the conclusion that it probably made more sense to talk of Practical-theological alternatives rather than to describe the subject in a single fixed manner of understanding and action. In the age of neoliberalism, feminists strongly disagree on the ideal legal status of prostitution while the pro-prostitution lobby endeavours to keep their male-dominated business running smoothly. Feminist debates should be concerned with the sex buyers' belief system about women, which is likely to have practical consequences in the way they behave with women (prostituted and non-prostituted) in terms of sexuality and, therefore, for feminist purposes of equality, on a broader scale. A Critical Discourse Analysis of buyer-authored online reviews of (...) prostituted women provides the opportunity to verify whether the relationship they establish with them is based on democratic mutual equality or gendered power relations driven by domination and subordination.En la era del neoliberalismo, no hay consenso entre las feministas acerca del estatus legal que debería tener la prostitución; mientras, el lobby pro-prostitución intenta proteger tan lucrativo negocio. Los debates feministas deben abordar críticamente el sistema de creencias de los sujetos prostituyentes, en tanto que afecta a cómo actúan con las mujeres (prostituidas y no prostituidas) dentro del marco de la sexualidad y, por tanto, al potencial logro de la igualdad fáctica a nivel social. El análisis crítico del discurso online de los sujetos prostituyentes sobre las mujeres prostituidas permite comprobar si las relaciones que establecen con ellas están basadas en términos igualitarios o en la dicotomía dominación-subordinación característica de las relaciones de poder de género.
